Alabama Fetal Homicide Ruling Could Send Roe V. Wade Back to High Court

make its way up to the U.S. Supreme Court to revisit the 1973 Roe v. Wade ruling.

The Washington Times reports the case in Alabama involved Jessie Livell Phillips, who was convicted of killing his wife when she was eight weeks pregnant. The court sentenced him to death for the murder of “two or more persons.”

He appealed, arguing that an unborn child is not a person.

The state Supreme Court upheld his death sentence, citing the state’s interest in protecting the life of both the born and unborn.

One of the Alabama justices said the case should go up to the High Court because it is a “logical fallacy” for the government to consider a fetus a life in a murder conviction but not when it comes to a woman deciding to get an abortion.
