An Intermediate Victory for Colorado Baker

Masterpiece Cakeshop owner Jack Phillips scored an early win on Friday after a U.S. District Court judge in Denver allowed a lawsuit filed against the state of Colorado by the baker for its hostility toward him and his religious beliefs to move forward.

The Alliance Defending Freedom, who is representing Phillips, said U.S. District Court Senior Judge Wiley Daniel said the lawsuit can go forward because the baker was able to “demonstrate that the actions by the state are causing injury.”

ADF argues that the state is “violating Phillips’ First Amendment free exercise of religion rights by continuing to treat him differently than other cake artists and by acting with hostility toward him and his faith.”  

ADF filed suit after Colorado prosecuted Phillips a second time even after he won an earlier case at the U.S. Supreme Court.
